How do I appeal against an income tax order?

File an appeal in Form 35 before the Commissioner of Income Tax (Appeals) within 30 days of receiving the order. If you are still unhappy, appeal to the Income Tax Appellate Tribunal within 60 days of the appellate order. Time limits are strict, so act quickly.

The appeal ladder

If you disagree with an assessment order, the first appeal usually goes to the Commissioner of Income-tax (Appeals), or the Faceless Appeal system. A further appeal lies to the Income Tax Appellate Tribunal, and then on questions of law to the High Court. Each level has strict time limits.

Why time matters

The usual period to file the first appeal is 30 days from the date the order is served. Delay needs a condonation request with reasons, which is not guaranteed.
