How do I file a GST appeal?

File an appeal in Form GST APL-01 before the first appellate authority within three months of the order, extendable by one month for sufficient cause. A pre-deposit of 10 percent of the disputed tax is generally required. A further appeal lies to the GST Appellate Tribunal.

GST Appeal: what you should know

Appeals under GST

An order passed by the adjudicating officer can be appealed to the first appellate authority within the time allowed, followed by the GST Appellate Tribunal as notified and then the High Court on questions of law. A pre-deposit of part of the disputed tax is generally required.

Preparing the case

We read the show cause notice and the order, check whether the time limits and procedure were followed, and draft the grounds with supporting documents. Many orders can be challenged on procedure, such as notice defects or missed hearings.

Deadlines

The first appeal is generally due within three months of the order. Pre-deposit and the correct form matter, and delays can be condoned only within limited periods.
